Privacy Policy

This Privacy Policy (hereinafter the "Policy") is established by Shosin Labs, an independent software studio (hereinafter the "Developer") with respect to the bMusic application for iOS (hereinafter the "Application").

Article 1 (Purpose)

The purpose of this Policy is to set out the information processed by the Developer, or by third parties, in connection with the provision and use of the Application, the purposes for which such information is processed, and the means available to the User in respect of such information.

Article 2 (Definitions)

In this Policy, the following terms shall have the meanings set out below:

(a) "User" means any person who installs or uses the Application;

(b) "Library Data" has the meaning given in Article 3, paragraph 1;

(c) "Usage Data" has the meaning given in Article 4, paragraph 1; and

(d) "Apple" means Apple Inc. and, where the context so requires, its subsidiaries.

Article 3 (Library Data Stored on the Device)

1. The audio files, artwork, lyrics, playlists, tags and play history of the User (hereinafter collectively the "Library Data") shall be stored on the User’s device. Lyric transcription, stem separation and karaoke processing shall be performed on the User’s device. The Developer does not operate user accounts, nor does it operate any server for the storage of Library Data.

2. Where the User enables iCloud sync, the Library Data shall be synchronised between the User’s devices by means of the User’s own iCloud account. Any copy so synchronised is held by Apple within the User’s account, and the Developer has no access to such copy.

Article 4 (Usage Data and Crash Reports)

1. The Application uses Google Firebase Analytics and Firebase Crashlytics to collect usage statistics and crash reports, comprising information on the manner in which the Application is used, the performance of the Application, the device model, the operating system version, the Application version, and the language and region settings (hereinafter collectively the "Usage Data").

2. Usage Data shall be linked to a random identifier assigned to the User’s installation of the Application, and shall not be linked to the User’s name or to any account. The Developer shall use Usage Data solely for the purposes of understanding and improving the Application.

3. Usage Data is processed on behalf of the Developer by Google (see Firebase privacy information).

Article 5 (Health, Motion and Microphone)

1. Subject to the permission of the User, the Application shall:

(a) on the Running screen, read the User’s heart rate from Apple Health and the User’s step data from Motion & Fitness for the purpose of matching songs to the User’s pace; and

(b) on the Sing Along screen, use the microphone to record the User.

2. Heart-rate data and recordings shall remain on the User’s device. The Application reads from Apple Health only and does not write any data to Apple Health.

3. The User may withdraw any of the foregoing permissions at any time by means of the iOS Settings app.

Article 6 (Feedback)

1. Where the User submits feedback from within the Application, the Developer shall receive the message submitted, the email address of the User where the User elects to provide one, and basic information concerning the Application and the device.

2. Feedback shall be used solely for the purposes of responding to the User and improving the Application.

Article 7 (Advertising)

The Application contains no advertising and does not use an advertising identifier.

Article 8 (Children)

The Application is not directed at children.

Article 9 (Deletion)

1. The User may delete songs, playlists and tags within the Application. Uninstalling the Application deletes the data stored by the Application on the User’s device.

2. The User may request the deletion of Usage Data associated with the User’s installation by contacting the Developer at the address set out in Article 11.

Article 10 (Amendment of this Policy)

The Developer may amend this Policy from time to time. Upon any such amendment, the Developer shall revise the date indicated at the top of this page.
